HEMOPHILIA AS DISABILITY

  1. SHRI HANUMAN BENIWAL:
    Will the Minister of SOCIAL JUSTICE AND EMPOWERMENT be pleased to state:

(a) whether it is a fact that despite granting the hemophilia disability as benchmark disability under section 2 (R) of the Rights of Persons with Disabilities Act, 2016, the persons suffering from hemophilia are deprived of reservation in Government jobs as per section 34(1) of the said Act along with the basis on which such deprivation is made;

(b) whether the Government proposes to provide reservation to the persons suffering from hemophilia in Government jobs under section 34(1) of this Act keeping hemophilia disability in said section in view the discrimination against hemophilia Divyangs, low health status, low social status and low economic level, if so, the details thereof;

(c) whether the Government has taken any action on the representations etc. received from time to time regarding the said demand; and

(d) if so, the details thereof and if not, the reasons therefor?

ANSWER

MINISTER OF STATE FOR SOCIAL JUSTICE AND EMPOWERMENT (SUSHRI PRATIMA BHOUMIK)

(a) The Government enacted the Rights of Persons with Disabilities (RPwD) Act, 2016, which came into force on 19.04.2017. Disability caused due to blood disorders including haemophilia is recognized as specified disabilities under the said Act. However, in terms of Section 34(1) of the aforesaid Act, the benefit of reservation in Government jobs is applicable to the following categories of persons with benchmark disabilities:

(i)blindness and low vision;1%
(ii)deaf and hard of hearing;1%
(iii)locomotor disability including cerebral palsy, leprosy cured, dwarfism, acid attack victims and muscular dystrophy;1%
(iv)autism, intellectual disability, specific learning disability & mental illness; and1%
(v)muliple disabilities from amongst persons under clauses (i) to (iv) including deaf-blindness

(b) No, Sir.

(c) and (d) Representations received in the Ministry from time to time are responded to keeping in view the above provisions of RPwD Act, 2016.
