Electricity Amendment Bill 2022 Overview
The bill aims at allowing the licensing of multiple discoms for supply in the same area as well as the fixing of minimum and maximum tariffs. While the bill intends to impose a universal service obligation on all licensees, it allows national and state dispatch centres to cut power supply if the discoms don’t give bank guarantees.
The bill provides for management of power purchase and cross-subsidy in case multiple distribution licensees exist in the same area of supply, it allows network sharing for optimum utilization as well as proposes an enhanced rate of penalty for non-compliance with the revised provisions.
Provisions of the Bill
Clause I seeks to amend section 2 by inserting immediately after the word “export” the word “and” and by repealing the
words “and distribution” appearing after the word “import”.
Clause 2 seeks to amend section 3(l) of the principal Act on the definition of the word electric supply line by repealing the words “but does not include any telegraph or telephone line”.
Clause 3 seeks to amend section 7 to provide for a staggered term of service of the members of the Board for continuity of the activities of the authority at the expiry of the term of some members.
Clause 4 seeks to amend section 10 by substituting for the words “transmission and distribution companies” the word “licensees” in paragraph (g) and by inserting new paragraphs (qa),(qb), (qc) and (qd) to provide for additional functions of the authority.
Clause 5 seeks to amend section 22by substituting for “0.3” the to increase funding to the authority and to provide for an additional source of funding to the authority from income generated from services rendered. This will ensure that the
authority has adequate funds to regulate the electricity industry.
