Sub:- Revision of pension of pre-2006 pensioners – reg.
The undersigned is directed to say that as per Para 4.2 of this Department’s OM of even number dated 1.9.2008 relating to revision of pension of pre-2006 pensioners w.e.f. 1.1.2006, the revised pension w.e.f. 1.1.2006, in no case, shall be lower than 50% of the sum of the minimum of pay in the pay band and the grade pay thereon corresponding to the prerevised pay scale from which the pensioner had retired. A clarification was issued vide DoP&PW OM of even number dated 3.10.2008 that the pension calculated at 50% of the minimum of pay in the pay band plus grade pay would be calculated at the minimum of the pay in the pay band (irrespective of the pre-revised scale of pay) plus the grade pay corresponding to the pre-revised pay scale.

Several petitions were filed in Central Administrative Tribunal, Principal Bench, New Delhi inter alia claiming that the revised pension of the pre-2006 pensioners should not be less than 50% of the minimum of the pay band + grade pay, corresponding to the pre-revised pay scale from which pensioner had retired, as arrived at with reference to the fitment tables annexed to Ministry of Finance, Department of Expenditure OM No.1/1/2008-IC dated 30th August, 2008. Hon’ble CAT, Principal Bench, New Delhi vide its common order dated 1.11.2011 in OA No.655/2010 and three other connected OAs directed to re-fix the pension of all pre-2006 retirees w.e.f. 1.1.2006 based on the Resolution dated 29.8.2008 of the Department of Pension & Pensioners’ Welfare and in the light of the observations of Hon’ble CAT in that order.

The above order was challenged by the Government by filing Writ Petition No.1535/2012 in respect of OA No. 655/2010 and WP No.2348-50/12 in respect of the three other connected OAs in the High Court of Delhi. The Hon’ble High Court in Its common Order dated 29.4.2013 noted that the DoP&PW had, in the meanwhile, issued an OM No.38/37/08-P&PW (A) dated 28.1.2013 which provided for stepping up of pension of pre2006 pensioners w.e.f. 24.9.2012 to 50% of the minimum of pay in the pay band and grade pay corresponding to pre-revised pay scale from which the pensioner had retired. Hon’ble High Court observed that the only issue which survived was, with reference to Paragraph 9 of OM dated 28.1.2013 which makes it applicable w.e.f. 24.9.2012 instead of 1.1.2006. Hon’ble High Court of Delhi dismissed the Writ Petition No.1535/20 12 along with three other Writ Petitions vide its order dated 29.4.2013. Special Leave Petitions (No.23055/2013 and No.36148-50/2013) filed against the said order dated 29/4/2013 of the Hon’ble Delhi High Court have also been dismissed by the Hon’ble Supreme Court.

Accordingly, in compliance with the above judicial pronouncements, it has been decided that the pension/family pension of all pre-2006 pensioners/family pensioners may be revised in accordance with this Department’s OM No.38/37/08-P&PW(A) dated 28.1.2013 with effect from 1.1.2006 instead of24.9.2012. Further, this benefit has already been granted to the Applicants in OA No. 655/2010 vide OM of even No. dated 26/08/2014 read with OM dated 19/09/2014 following dismissal of SLP (C) No.23055/2013 by the Hon’ble Supreme Court.
5. In case the consolidated pension/family pension calculated as per para 4.1 of O.M. No.38/37/08-P&PW (A) dated 1.9.2008 is higher than the pension/family pension calculated in the manner indicated in the O.M. dated 28.1.2013, the same (higher consolidated pension/family pension) will continue to be treated as basic pension/family pension.
6. All other conditions-as given in OM No. 38/37/08-P&PW (A) dated 1.9.2008, as amended from time to time shall remain unchanged.
7. Ministry of Agriculture, etc. are requested to bring the contents of these orders to the notice of Controller of Accounts/Pay and Accounts Officers and Attached and subordinate Offices under them on a top priority basis. All pension disbursing offices are also advised to prominently display these orders on their notice boards for the benefit of pensioners.
8. This issues with the approval of Ministry of Finance ID Note No. 1(9)/EV/2011Vol.1I dated 24.7.2015.

I am happy with your site to update govt.order on pension etc. I was ret. on 31.8.14 from I Rly. in JAG grade. Let me know wether bank has been asked to pay revised pension with arrears w.e.f August 16 or seprate notification will come for pensinors.

om dt30/7/15& link with om 28/1/13 the annexure prepare by fm /pp&w dept, totaly contradict ccs pension rule1972 also their all om
write a stories as a clarifatory om from begining end with issue om dt6/4/16 same proceder ,but whether their intension to clear all
disparity done earlier om .So my dear friends not all
benefit.Now 3tire formula adopted as a rule of law.Ie
50%/.48%/40% as per their om.

sir, i retired on 31.12.1990 on basic pay 1950/ but my pension fixed 895/ instead of 975/- on sixth cpc i m getting the basic pension 7215/ and grade 9300-34800 grade pay 4200 what will my pension in sevnth cpc and did i m getting my pension ok in six cpc please reply

I RETIRED FROM E.RLY AS DATA BASE SUPDT. UNDER CCM/PM/ER/KOL. ON 31/12/2007 BEFORE IMPLEMENTATION OF 6TH CPC. IN PAY SCALE 6500 – 200 -10,,500. IN BASIC 8900. MY PENSION WAS FIXED AS Rs.6585/INCLUDING DP. MY INCREMENT DATE WAS IN SEPTEMBER. WHILE FIXING MY PAY IN 6TH CPC WEF 1.1.2006 WITH BASIC AS 8500/ MY BASIC WAS FIXED AT Rs/21,660 ON 31/12/2007(OLD BASIC Rs/8900)
AND MY PENSION FIXED AS 10,830. BUT IF I WOULD NOT GET THE BENIFIT OF 6THCPC MY PENSION WOULD HAVE BEEN FIXED AS Rs/6585X 1.86= 12,248.
WHY THIS ANAMOLY. PLEASE ERADICATE MY CONFUSION.

Sir, I am permanently absorbed in CPSU and my 1/3rd restored pension has not been fixed or nor any satisfactory reply is given by DOPT. Several letters have been written on this subject. Now I understand that one O.M. No. 38/77-A/09-P&PW(A) vol.II (Pt.1) dated 18.09.2015 which states that in terms of OM dated 30.07.2015 pension of absorbees should not be revised since the matter is under consideration with Ministry of Finance for proposal of minimum of pension. Pl. clarify the decision if taken by the Ministry of Finance..

4150 . on 1/1/06 my pension was fixed 9334/ pl tell me am I entitled for calculation of grade pay wef 1/1/06 and what benefit will l get .what is the amount of arrears from 1/1/06 to 31/12/16

I retired from Integral Coach Factory on 31-3-1995. So I become eligible to get the revised pension as per latest decision of cpc-6. I am very much expecting payment of the pre 2006 pension arrears.
will it be paid normally through pension paying banks as we are receiving monthly pension or any special procedure to be followed for claiming the arrears. kindly highlight

Sir,
I rtd.from Rly on 31st May 2004 after 29 year’s of service with last pay drawn Rs.11500. 00 in the scale Rs.7450 -11500. My pension is fixed Rs.11310. 00 as per para 4.1. w. e. f. 01 -01 -2006. If it is fixed under para 4.2 as per 6th CPC Recommendations it is more beneficial to me. If I am right, please let me know whom to be contacted. In this regard after many requests to my parents official, but no answer till date. Please advise me accordingly. Thank you very much.

My husband was expired on 29-09-1980 while in service in the Dept. of Posts, as Inspector of Post Offices ,Dept Of Posts, in the pay scale of 425-700 (4th CPC ) and my family pension was last revised to Rs 1414/ w.e.f 1.1.96 (5th CPC),which fixed on the basis of upgraded pre revised scale of Inspector of Post Offices from RS 1400-2300 to Rs 5500-9000 and but the same was not revised w.e.f 1.1.2006 ( 6th CPC) against the corresponding pay scale of PB-2 9300-34800 GP -4200 and at present I am getting minimum pension of RS 3500/+DR w.e.f 1.1.2006 ( 6th CPC) instead of Rs. 4329/ as per order dt28-01-2013 .
Moreover it is also noticed that the said pre revised scale of Rs 5500-9000 was also merged with scale 6500-10500 in 6th CPC ( Copy enclosed ) against the same scale of 9300-34800 GP 4200 PB 2 and accordingly revised family pension will be Rs 4887/.
Kindly clarify that that my full family pension w.e.f 1.1.2006 to be on up graded scale or not.

Kindly explain how the revised pension is working out/calculated for a pre-2006 pensioner(2004) as per the GOI order dated 30-7-2015? How the amount shown in the fitment table taking into account for a pensioner who was drawing,Rs.6200/-before retirement in the pay scale of Rs.5000-150-8000.New PB-2,( Rs9300-3400).Any calculation formula issued by Govt.?Anybody checked how the amount arrived at fitent? Pl,clarify correct position.Thanks

OA 655/2010 decided on 1.11.2011 deals with three points—Govt has taken care of only one point vide memo dated 30 July.2015 The other two i.e. UPGRADED SCALES/GRADE PAY to retirees and PRO RATA pension (full pension to retires between 20years and 33 years of service) have been ignored. WHY ? Waiting for Contempt proceedings . Why does Govt want to increase the load of the judiciary? Do they want to harass/push senior citizens to courts in their old age ? Why is Govt avoiding a legal reality The Apex Court of the land has approved a point and it is being flouted. It is illegal,criminal,unethical and immoral. The Country”s leadership should look into it .

dear mr k.c.sastry. This reply is in response to your quesry dated august 4th.
The para (3) of the above letter dated 30-7-15 mentions re fixation of pension that was fixed from 1-1-2006 as per the revised table. please go through that letter. In case your pension was stepped up as per the table given in that letter of 28-1-2013 , wherein the arrears are effected from 24-9-2012. Again theis was respresented and now govt sanctoned the arrears from 1-1-2006 to 23-9-2012.
Majority of pre2006 got benefit of steopping up of pension wef 24-9-2012 as per the letter dated 28-1-2013. For some there was no stepping up of pay hence there was no revision from 24-9-2012. so it is case basis . once u read the letter the mattr will be clear to you.

Kindly intimate whether the latest orders issued on 30/31st July are applicable to all central govt pensioners who retired before 01-01-2006 or applicable to a particular cadre pensioners. If applicable to all pre2006 pensioners pl advise where one can find the ready reckoner for knowing the revised pension as per latest orders.

Sir, I retired on attaining age superannuation on 30/4/1996,as Principal of a Govt. Senior Secondary School of Delhi. In the scale of 10,000-325=15200, I was drawing my Basic pay @ 11625 p.m. As per GOI Notification dated 29/8/2008,Rule 7,Note 2Clause A(I)(ii) , Part-B, Section ll , the said Scale was upgraded to PB-3 , Rs. 12000-16500, with grade Pay of Rs. 7600. Later on the said Scale was revised to 15600-39100 with Grade pay of Rs, 7600..
My pension was revised & fixed in the Pay band of Rs. 15600-39100 with Grade Pay of Rs. 6600, whereas those who retired after 1/1/2006 , got their pension fixed in the Pay Band of 15600-39100 with Grade Pay of Rs. 7600.ad written to the Ministry of Finance, CPAO, Controller of Accounts of the Govt.of NCT of Delhi & various other Authorities. Till date nobody has cared to explane the said differentiation . My Pension should have been fixed @ 14960 instead of 12881. Will I get justice.

PENSION DISBURSING AUTHORITIES (PDA) LIKE BANKS AND POST OFFICES ARE NEVER WORRIED OR BOTHERED TO WORK OUT THE BASIC PENSION ACCORDING TO THE ORDER. THEY WANT COOKED MEALS LIKE THE FIGURE TO BE PAID EVERY MONTH AS QUOTED ON THE PPO, BECAUSE THEY DO MAY OR MAY NOT HAVE THE PAY BAND AND GRADE PAY OF PREREVISED SCALE OF THE RETIREE HAD LAST LAST PAY DRAWN. THEREFORE,THE CDA (P) IS REQUIRED TO CALCULATE AND ISSUE SUITABLE CORRIGENDUM TO THE PPO ALREADY ISSUED TO ENSURE PAYMENT OF CORRECT ENTITLEMENTS TO THE PRE 2006 PENSIONERS.
THIS MATTER NEEDS TOBE TAKEN UP WITH GOVT/CGDA FOR IMPLEMENTATION OF THE ORDERS SOON BY THE PDA.
