Notification – amendment in FR 1961

NOTIFICATION

SUBJECT: Notification – amendment in FR 1961

In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller and Auditor General in relation to persons serving in the Indian Audit and Accounts Department, the president hereby makes the following rule further to amend the Fundamental Rules, namely:-

1.(i) These rules may be called the Fundamental (Tenth Amendment) Rules, 1961.

(ii) They shall be deemed to have come into force from the 1st day of April, 1961.

2.The fundamental Rules, after rule 22-B, the following rule shall be inserted, namely:-

“F.R.22-C. Notwithstanding anything continued in these Rules, where a Government in these Rules, where a Government servant holding a post in a substantive, temporary or officiating capacity is promoted or appointed in a substantive, temporary or officiating capacity to another post carrying duties and responsibilities of greater importance than those attaching to the post in the time-scale of the higher post shall be fixed at the stage next above the pay notionally arrived at by increasing the actual pay drawn by him in the lower post by one increment at the stage at which such pay is drawn:

Provided that the provisions of this rule shall not apply where a Government servant holding a Class I post in a substantive, temporary or officiating capacity is promoted or appointed in a substantive, temporary or officiating capacity to a higher post which is also a Class I post;

Provided further that the provisions of sub-rule (2) of rule 31 shall not be applicable in any case where the initial pay is fixed under this rule;

Provided also that where a Government servant is immediately before his Promotion or appointment to a higher post, drawing pay at the maximum of the time-scale of the lower post, his initial pay in the time-scale of the higher post shall be fixed at the stage in that time-scale next above such maximum in the lower-post.

Explanation:- In this rule, the expression “Class I” has the meaning assigned to it under the Central Civil Services (Classification, Control and Appeal) Rules, 1957.”
