OFFICE MEMORANDUM
Subject:- Grant of benefit under the “Next Below Rule” .
The undersigned is directed to refer to this Ministry’s orders contained in O.M.No.6(23) –E.III/62 dated the 29th January, 1963 and to say that the question of the grant of benefit of officiating promotion under the Next Below Rule to officers who are outside the cadre has been reviewed and the President is pleased to decide as follows;
2. The benefit of officiating promotion under the next below rule should be allowed, subject to the fulfillment of the conditions laid down thereunder, only against promotions in a cadre in vacancies of more than 120 days duration. In other words, the initial vacancy as well as subsequent vacancies on the basis of which the benefit is to be continued should each be more of than 120 days’ duration. The benefit should not be allowed in respect of promotions against a chain of vacancies which taken together extend beyond 120 days.
3. In so far as Government servants serving in the Indian Audit and Accounts Department are concerned, these orders have been issued in consultation with the Comptroller and Auditor General of India.
