OFFICE MEMORANDUM
Subject:- Fixation of pay of persons re-promoted after 1.4.61 to the posts held by them prior to 1.7.59.
The undersigned is directed to refer to Rule 13(3) of the CCS (III) Rules, 1960 and to say that a question has been raised whether the benefit of this sub-rule would also be available in cases where promotions have been made on or after 1.4.61, the date of introduction of F.R. 22-C. It is clarified that the benefit of Rule 13(3) of CCS (III) Rules, 1960, pay also be allowed in cases where an officer is promoted after 1.4.61 to the same post in which he had rendered service in the prescribed scale of pay prior to 1.7.59, if the pay fixation under this sub-rule is more advantageous than the fixation of pay under F.R. 22-C.
2. This clarification takes effect from 1st April 1961 and past cases decided otherwise may be reconsidered by the Administrative Ministries/Departments concerned and pay refixed accordingly. No arrears will, however, be paid for the period prior to the date of issue of these orders. Cases where arrears had been allowed in the past may not, however, be re-opened.
3.In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General.
