OFFICE MEMORANDUM

Subject:- Counting for initial fixation of pay/increments of service rendered by an officer in a scale of pay higher than or identical with that of a post in the parent cadre.

The undersigned is directed to refer to this Ministry’s Notification No.1(25)-E.III(A)/64 dated 30-11-65 as amended by Notification of even number dated 1-10-1966 and also Office Memorandum of even number dated 30-11-1965 on the subject mentioned above.

2.A doubt has been expressed as to whether the benefit of proviso 1(iii) to FR 22 in respect to protection of pay and period of increment would be admissible to Government servants on their appointment directly or on transfer from a post carrying an identical time scale of pay, without fulfillment of the conditions mentioned below para.3 of this Ministry’s office Memorandum dated 30-11-1965 cited above. It is clarified that in such cases the benefit mentioned above will be admissible without fulfillment of the condition thereunder subject to paragraph 3 below.

3.This benefit will not be admissible to an individual who enters Government service for the first time from a post in a body, incorporated or not which is wholly or substantially owned or controlled by Government.

4.In cases of reversion from an ex-cadre to a cadre post on an identical time scale of pay the benefit of proviso 1(iii) to FR 22 shall be admissible subject to the fulfillment of all the conditions mentioned under the said proviso.

5.Cases, if any, decided otherwise than in accordance with these clarifications after the 30-11-1965 may be reviewed and regulated correctly.
