OFFICE MEMORANDUM
Subject:-Central Civil Services(Revised Pay)Rules 1960 Application of the “revised scales” of pay to persons appointed to posts after the 1st of July, 1959.
The undersigned is directed to refer to the Ministry of Finance Office Memorandum No.F.12(16)-Est(Spl)/60, dated the 14th November, 1961 on the subject mentioned above and to say that certain doubts have been expressed in the application of the provisions contained therein.The points on which the doubts have arisen have been examined and the President is pleased to issue the following clarifications for the information and guidance of
all concerned:-
(a) All persons recruited after the 1st July, 1959 or appointed by transfer or promotion to other posts after that date should be allowed pay only in the
“revised scales” as admissible under the Central Civil Services (Revised Pay) Rules, 1960
(b) If in the case of any person referred to in (a) above, the pay and dearness allowance as fixed in the reviseed scale of pay on 2.8.60 is less than the
emoluments, ie., basic pay and dearness allowance (including dearness pay and interim relief) appropriate thereto actually drawn or would have
been drawn in the pre-revised scale on 2.8.60, then the difference shall be allowed as personal pay. The personal pay that become admissible on this
basis shall be absorbed in future increases in pay.
(c) Consequent on the refixation of pay in the revised scales with effect from 2-7-1959 or a later date as the case may be, the next arrears or overpayments as on 2.8.1960 or on the date of issue of the formal orders or notifications revising the scales of pay, whichever is later, shall be worked out taking into account the personal pay also for the period from 2.8.1960, if any arrears thus become admissible they shall be allowed.
(d) All overpayments resulting from the refixation of pay in the revised scales upto the date of issue of the CCS(RP) Rules 1960, i.e. 2.8.1960 or
subsequent notifications or orders revising the scales of pay, will be waived in accordance with the orders contained in this Ministry’s Office Memorandum No.F.12(14)-Est.(Spl)/60, dated the 9th May,1961.
(e) In respect of officers of the former Established Central Services, Class-I, the fixation of pay of persons promoted to senior scale after 1.7.l1959
will, however/under teh orders contained in this Ministry’s Office Memorandum No.F.12(16)-Est(Spl)/60 dated the 1st December 1961. Officers of these Services whose fixation of pay is not covered by the provisions of this Office Memorandum will have their pay resulted in accordance with the orders contained in the Office Memorandum of even No. dated the 14th November 1961 read with the clarifications contained in (a) to (d) above.
(f) The orders contained in this Ministry’s Office Memorandum dated the 14th November 1961 and 1st December 1961 will not be applicable to persons appointed by transfer, promotion or recruitment to posts on or after 2.8.1960 even if the revised scales of pay in their cases have been notified on or after this date. In their cases the question of waiver of overpayments upto the date of issue of formal orders or notifications revising the scales of pay will be dealt with in according with the orders contained in the Office Memorandum dated the 9th May, 1961, referred to above.
2.The provisions contained in paragraph 3(i0 and (ii) of this Ministry’s Office Memorandum dated the 14th November 1961 referred to above may be deemed to have been modified to the extent indicated in para 1 above.
