Subject : Updation of ACRs and other records in respect of Superintendent of Central Excise – Reg.
Sir / Madam,
Cadre Restructuring Plan of the field formations is likely to be approved soon by the Government of India. The Plan envisages creation of new / additional posts at various levels of official hierarchy of the Department, including at the level of Dy. / Assistant Commissioner.
2.1 Considering imminent approval of the plan, various steps are required to be taken immediately to ensure implementation of approved cadre restructuring plan as soon as possibile. One of the most important steps that are required to be taken is updation of service records of the officers at all the levels, so as to ensure that the promotions to various grades against cadre restructuring vacancies are not delayed due to incomplete dossiers of the officers. Accordingly it is requested that the service records (ACR gradings for the last ten years, Integrity Certificates, Vigilance Clearance etc.) of the officers working in the grades of Superintendents of Central Excise, are updated immediately, so that the same can be provided to DGHRD / CBEC at the short notice for convening DPC Meetings for promotion to the grade of Assistant Commissioner (Junior Time Scale). Lists of the Officers of the grade of Superintendents of Central Excise, who may come under the consideration zone, are enclosed for kind convenience. Following is the list of documents that are required for conduct of DPC meetings:
(i) Vigilance Clearance Certificate as on date in terms of DOP&T’s OM dated 14.09.1992 & 02.11.2012.
(ii) Integrity Certificate (on the basis of entries made in the integrity column in ACR) – Adverse entries, if any may also be highlighted,
(iii) Major / Minor penalty statement for last 10 years.
(iv) Certificate in terms of DOP&T’s OM No.21011/2005-Estt.(A)/(Pt.II) dated 14.05.2009,
(v) Certificate in terms of DOP&T OM No.21011/1/2010-Estt.A dated 13.04.2010.
2.2 In case of ACR/APAR of any officer for any particular year / period is missing / not reviewed, Non-availability / ACRs not reviewed of such ACR should be properly supported by a ‘No Report Certificate’ (NRC). Complete ACRs Dossiers for five years (extended by as many years as there are NRC entries would have to be made available to DGHRD / CBEC for convening DPC meetings. Format of “No Report Certificate” is enclosed herewith for ready reference.
2.3 The formative Texts of various Certificate that is required to kept ready for furnishing to DGHRD / CBEC whenever called for is reproduced below.
(a) Vigilance Certificate:
“The records of service of the following officers who are to be considered for promotion in the grade of Assistant Commissioner have bee carefully scrutinized and it is certified that no vigilance case is pending against any of these Officers.”
Or,
“The records of service of the following officers who are to be considered for promotion in the grade of Assistant Commissioner have been carefully scrutinized and it is certified that they are not free from vigilance case(s)”.
Vigilance Clearance Certificate should be signed by an officer of the rank not lower than the rank of Under Secretary.
Details is required to be submitted in enclosed Proforma ‘E’.
(b) Integrity Certificate:
“The records of service of the following officers who are to be considered for promotion in the grade of Assistant Commissioner have been carefully scrutinized and it is certified that there is no doubt about their integrity.”
Or
“The records of service of the following officers who are to be considered for promotion in the grade of Assistant Commissioner have been carefully scrutinized and there integrity is NOT Certified”.
List of officers whose Integrity is certified as “Beyond Doubt” should be signed by a Deputy Secretary or above rank Officer.
(c) Penalty Statement:
A “Penalty Statement” showing Major / Minor penalties, if any, imposed upon the eligible officers during last 10 years should be prepared and kept ready as per Proforma ‘F’.
“It is certified that the ACR (APAR) for the years 2008-09 to 2012-13 of all eligible officers who are to be considered for promotion to the post of Assistant Commissioner of Customs & Central Excise has been shown to them. None of the Officers except S/Sh ________ for the period (s) _______ has made any representation against grading given to them within the specified period in the aforesaid OM. The representation of Shri______ for the period (s) _______ has been considered and speaking order issued and placed in the CR dossier”
2.5 A certificate of DOP&T OM dated 13.04.2010 should also be issued as under:
“It is certified that all the ACRs for the period from ______ to ___________ (including ACRs) of equal numbers pertaining to earlier periods in case of non-availability of some ACRs between _______ to _______) in respect of all the officers coming in Zone of consideration whose names have been included in the eligibility list of have been gone through in terms of DOP&T OM No. 21011/1/2010-Estt.A dated 13.04.2010 and found that none of the ACRs is below the benchmark grading, i.e. “Good”, except in case of S/Sh ________ for the period (s) _____________ against whom necessary action as per DOP&T OM dated 13.04.2010 has been taken and copies of appropriate orders have been placed in the C.R.dossiers.”
The aforementioned preparations should be completed by 15th September, 2013, and an ‘Action Taken Report’ submitted to DGHRD by 16th September, 2013.
