    Sir,
An employee got promotion on 01/04/1992 in the scale 2000-60-2300-EB-75-3200-100-3500 & his last basic pay on the very previous date of increment i.e. 01/02/1992 Rs. 1940/- in the scale 1640-60-2600-EB-75-2900. On the date of promotion, the pay in previous scale will be 2000/- after adding one increment in the previous scale.

What will be the basic in the promoted scale whereas Rs. 2000/- slab is available in the new scale? Will the pay be fixed Rs. 2000/- or in the next higher slab i.e. Rs. 2060/-.

    please guide sir

That employee’s basic pay fixed from 1-1-1996 in the 2000- scale for him . Also check up previous scale on 1-2-1992. So, 1992 to 1996 4 years increments he might have go in old scale of 4th CPC.

    Sir
Can any body clarify on my email ID on following issue:
MOF /DOPT orders are there that those who are between 1.1.06 to 29.8.2008 in pay scale having grade pay are to be fixed in basic pay of 18460/- . Many departments say Trained teachers of Education deptt won the court cases and allowed 18460/- to them and similarly in many departments 18460 is allowed as per MOF/DOPT orders but some departments are yet to implement this order despite lossing case by some departments in Supreme court . Shri Niraj Shekhar MP Rajyasabha had also raised question in Rajyasabha during the month of November 2019 and govt had replied some positive reply but fixation at 18460/- basic pay is not implemented by some govt deptt.
Kindly clarify for non implementation of court/govt orders for fixation in 18460 –

Notional increment to the pensioners retired on June 30 should be taken up on war footing. He works for the whole year sincerely and in the end becuase he is retiring on 30th june, he does not get incfrement for that period for which he has served, is it not a grave injustice to the employee. reired on 30th June .Earlier te rule was different, so the people did not have any problem because they are eligible for the increment in the month when they enter/join the service. Now the government has unnecessarily introduced the system of increment in January or July and as a result the person who have retired in the month of June has to pay the hardship. Hence, Government should look into the matter on priority and order should be given to the all the department that the pers0n retired in June are eligible for increment and they should be given increment from the year the person retired Government shoud look into the mater seriously and notional increment should be given to all the pensioners who retired in the month of June and did not got the increment.. The concerned department may be instructed to release the notionalo increments whoever retired in the month of June.

Madam it is government policy. Like this those who are born on 1st day of month they retire on before that month. In the retired employee of last date of PAY COMMISSION they also not eligible for the next Pay Commissions Rules. Increment rules are they should be on the next day of duty. In the leave period also increment should be given on the day of joining duty. Also in the cases of death of government employee in duty as salary or after retired died their pension is given up to on that day and next day onward given to eligible person as enhanced pension/family pension of 60% rates respectively.

I notice that very persons only viewed and posted comments on notional increment for this retired on 30th June out of many effected persons..? I request all the effected persons to approach Confederation / JCM to take up the issue with request to reconsider the decision of Department of Legal Affairs/DoPT and grant the increment for those retired on 30th June. I understand this was decided against the effected persons mainly due to economic crisis of the country. This should be tackled by various other stringent measures, without effecting the pensioners.

Sir, pl go through the latest Judgement of CAT Ernakulam bench dated 3rd December 2019 in favour of all the pensioners who filed the case for notional increment. Now DoPT should issue a general guidelines for the grant of this increment. Influential persons may contact MPs, Ministers to instruct DoPT to issue guidelines at the earliest and not to drag all the effected pensioners to approach Court/CAT to bring individual orders, as this is a general issue effecting few pensioners.

Notional increment for those retired on 30th June. SLP and Review petition made by Govt on this issue dismissed by Supreme Court that means Supreme Court is agreeable for the grant of notional increment in line with the judgement of Madras Court judgement. But legal department of central govt defended against the effected persons main reason for defending against may be the economic crisis being faced by the govt. When the upper Court is for the decision taken by the govt is very much against the effected pensioners. Confederation should view this decision of the govt seriously and do the needful on humanitarian ground and fight for.
